Home Care Organizations (HCOs) with Home Care Aides (HCAs) can accept several types of insurance coverage to help manage the cost of care. The types of insurance may vary based on the services provided, the state, and the specific policies of the HCO. Below are common types of insurance that HCOs may accept:


  1. Long-Term Care Insurance: This type of insurance is specifically designed to help cover the cost of non-medical services like personal care, housekeeping, and companionship provided by HCAs. Many people use long-term care insurance to pay for home care services.
     
  2. Medicare (Limited Coverage): While Medicare typically covers only medical care, it may provide limited coverage for home health services, such as nursing or physical therapy, under specific conditions. However, non-medical home care services like personal care or companionship are generally not covered under Medicare.
     
  3. Medicaid: Some states offer Medicaid programs that cover home care services for low-income individuals who meet eligibility requirements. Medicaid can cover non-medical home care services like assistance with activities of daily living (ADLs) in certain cases, but the coverage varies depending on the state and program.
     
  4. Veterans' Benefits: Veterans may be eligible for home care services through the Department of Veterans Affairs (VA) if they meet the requirements for home care assistance. This may cover personal care services provided by HCAs, depending on the specific VA program.

Licensed Care (HCO)
With licensed care, caregivers are required to be registered Home Care Aides (HCAs), having completed necessary training, background checks, and tuberculosis clearances. The Home Care Organization (HCO) manages caregiver schedules, compensates for time off, and provides replacements when needed. If issues arise, the HCO maintains clear communication and is accountable for compliance. Additionally, the California Department of Social Services (CDSS) oversees HCOs, investigating complaints and enforcing penalties for non-compliance.

Unlicensed Care (Referral Agencies, Private Hires, etc.)
Unlicensed caregivers may not have formal training and could potentially have a criminal history, posing risks to your safety. These caregivers are often independent contractors, meaning there is little oversight, and issues like poor performance, absenteeism, or lack of qualifications may arise. CDSS does not regulate or investigate complaints against unlicensed care providers, leaving you with limited recourse if problems occur.

Employer Responsibility
In licensed care, the HCO handles all employer responsibilities, including workers’ compensation, unemployment insurance, and payroll taxes. With unlicensed care, you may be personally responsible for legal liabilities, such as workers' compensation claims or tax issues, making it a riskier and less protected option.

Yes, if you prefer that the caregiver drives the client’s vehicle, we require a Client Transport Waiver to be signed by the client or their representative. This ensures that the caregiver is authorized to drive the vehicle and that all necessary requirements are met.


What are the requirements for a caregiver to drive the client's vehicle? 


  • The client or their representative must sign a Client Transport Waiver allowing the caregiver to drive their vehicle.
  • The vehicle must be properly insured and in safe working condition.
  • The client must add the caregiver as an authorized driver on their auto insurance policy.


Will I be charged mileage reimbursement if the caregiver uses my car? 


No. When a caregiver drives the client’s vehicle, there is no mileage reimbursement charge for trips made on behalf of the client.


What if I prefer that the caregiver drives their own car? 


If a caregiver uses their personal vehicle to transport a client, mileage reimbursement will apply. The standard mileage rates for 2025 are: 70 cents per mile for business-related purposes. This can be discussed during the care planning process to determine the best transportation option for your needs.


What if I have additional questions or concerns?

Under California labor laws, caregivers, including Home Care Aides (HCAs), must be provided with appropriate meal breaks while on duty. The law ensures that caregivers receive adequate time to eat while continuing to provide care in a safe and professional manner.


Key Meal Break Regulations: 


  1. Meal Break Timing: Caregivers must be provided with a meal break of up to 30 minutes after working five (5) consecutive hours, whenever practical.
  2. On-Premises Requirement: Home Care Aides must remain at the client’s residence during meal breaks due to the nature of their responsibilities.
  3. Live-In Caregivers: Caregivers assigned to live-in schedules are entitled to three (3) meal breaks per day to ensure proper rest and nutrition.


Additional Considerations: 


  • Employers must provide a reasonable opportunity for caregivers to take their meal breaks.
  • If a caregiver is required to remain on duty during their meal break due to client needs, they may be entitled to compensated meal periods under California wage laws.
  • Caregivers must remain at the client’s residence during meal breaks and should bring a packed lunch, as leaving the home is not permitted. 
  • Employers must comply with California's Domestic Worker Bill of Rights, ensuring fair work conditions for caregivers.

In the event of a medical emergency, the procedure will depend on the client’s location:

  • If the client resides in a facility: The facility's emergency procedures will be followed, and the caregiver will adhere to the established protocols for emergencies.
  • If the client is in a private home: In the absence of a family member, the caregiver will assess the situation and make a determination whether to call 911 for emergency medical services. The caregiver will immediately contact the Coastal Comfort Caregivers office, and our care staff will promptly inform the family members about the situation.

3. Can the caregiver assist with caring for pets?
Yes, our caregivers can assist with pet care, including feeding, walking, and ensuring the safety and well-being of pets while you or your loved one receive care.
